These General Terms and Conditions are valid from 01.02.2019 and are valid until further notice.

General Terms and Conditions (GTC) apply to the online shop (Shop) maintained by The Finland Shop Oy and its usage. By purchasing products and by using The Finland Shop's online shop you agree to these General Terms and Conditions.

  1. Customers

You have to be 18 years old and have a permanent delivery address in the Shop's delivery area to be able to buy from our Shop.

 

 

  1. Login and Personal Data

You can browse and use the Shop as well as purchase from the Shop with or without login. However, when purchasing products from the Shop, we need the following information, which are stored in our customer register:

- Name

- Address

- Phone number

- E-mail address

- Product information about ordered products

- Other additional information provided by you

- Selected delivery and payment method

- Order tracking information

- IP address

- Web browser

- Device

You can also create an account as a registered customer. It will make your shopping easier and faster. You are responsible for the confidentiality of your username and password, and you are responsible for purchases made with your personal logins.

 

 

  1. Use of Personal Data

Your personal data will be processed in accordance with applicable legislation and the Privacy Statement. The data is stored in customer register maintained by the Shop. Your personal data will not be handed over to third parties. However, we reserve the right to hand over your personal data to authorities if you act in violation of law and good practice.

We use your personal data for direct marketing only if you give us your permission.

You have the right to check, modify or delete information about yourself from our customer register. If you would like to make changes to your personal data, please contact our customer service: info@thefinlandshop.com.

 

 

  1. Ordering

You place your order by adding selected products to the shopping cart. From the shopping cart, you continue to checkout where you provide customer information and choose the delivery and the payment method. At the checkout you will see selected products, total price and shipping cost for your order. When you click the Continue to Payment -button you continue to the payment gateway. By doing this, you accept the order and you agree to these GTC and Privacy Policy. When the Shop sends you an order confirmation a commercial agreement comes into force.

We try our best to guarantee the availability of all products. However, it may sometimes happen that a product is not available and we reserve the right not to accept your order. In this case, we are in contact with you to find the best solution. If the order information is unclear and we cannot get in contact with you, we also reserve the right not to accept the order.

 

 

  1. Product prices

When ordering you will see the current product prices including VAT. Shipping cost will be calculated based on your selected products and delivery country. You will see shipping cost for your order in the shopping cart before confirming your order.

Prices and shipping costs are processed in EUR. If there is a clear price error in a product price and it can be assumed that you have understood the mistake, we will contact you and the product price will be corrected.

When selling and delivering products to EU countries, displayed prices include VAT according to Finnish legislation.

When selling and delivering products outside the EU, you as customer are responsible for possible local taxes, customs duties, and other similar costs.

 

 

  1. Delivery

Delivery method in Finland: Posti.

Delivery method international: Posti in cooperation with local delivery companies.

The products will be sent to you once you have made the payment according to the payment terms. By deliveries in Finland your order will be delivered to the nearest Posti pickup location. By international deliveries your order will be delivered to the shipping address or to the nearest pickup location.

We use third party contract for the deliveries and this might have an effect on delivery time. However, we will process your order during the same or next weekday, so the normal delivery time in Finland is 2 to 5 days. International delivery time is 3 to 15 days. For special orders the delivery time is case specific.

If you do not pick up your parcel on time, it will return to us. A non-collected parcel is not an order cancelation, so we will charge you for shipping and handling.

The Shop is not responsible for any delays or other damages resulting from force majeure. Such can be e.g. strikes, decisions by authorities, disruptions in transport or illness of personnel.

Delivery costs are country specific. The destination country may charge VAT or other customs duties which are not included in our prices. You are responsible for these. The Shop does not pay any return costs for orders delivered outside of Finland.

 

 

  1. Return policy

You have the right to cancel your order by informing The Finland Shop Oy within 30 days after receiving your order. You must also return the product immediately after cancelling your order (within 14 days of the cancellation notice). However, the cancellation does not apply to products that have been modified or manufactured according to your specifications.

The requirement for a cancellation is that the product is in such a condition that it can be sold to another customer. Anything but opening the product packaging and checking the product is considered as use of the product. All parts of the product should be returned and the product must be packed in the original packaging or in an equivalent packaging.

We will refund all received payments or price differences for the cancelled order for the same payment method you used when paying in the Shop. We will also refund shipping costs for orders in Finland if the entire order is cancelled. When cancelling a part of an order, we will charge a shipping fee, which is deducted from the refundable amount.

Cancellation process:

Please contact us at info@thefinlandshop.com within 30 days after receiving your order. If the product is damaged, wrong or faulty, attach clear picture of the item and its package to your email.

We will reply with further instructions.

Once the cancellation has been confirmed pack the product and all parts in the original packaging. If the product package is damaged, pack the products in similar way so that they return unbroken, thank you! Please include also the filled return form.

Please keep the shipment receipt for at least three months, otherwise we will not take responsibility if the return parcel is lost during the delivery.

 

 

  1. Errors and Complaints

Please check your order immediately after receiving it to detect possible errors. If your order is missing items or the parcel is otherwise damaged, please notify the Shop immediately by email at info@thefinlandshop.com.

In the event of a complaint, the Shop has primarily the right to correct the error. If the error cannot be corrected, the Shop has the right to cancel the order.

Sometimes we use product arrangements in some of our product images. Please read the product description carefully so that everything is clear regarding your ordered product. The Shop may reject the complaint if it turns out that you have purchased the product without familiarizing yourself with the entire product description.

 

 

  1. Payment

We offer secured payment methods with Stripe, Paypal and Klarna.

Stripe

Credit card payments are processed securely via Stripe gateway.

PayPal

You need an own PayPal account when using Paypal as your payment method.

Klarna

Together with Klarna Bank AB (Public Address) (head office Sveavägen 46, 111 34 Stockholm, Sweden), we offer invoice (payment period 14 days) and part payment in selected countries. The payment will be done directly with Klarna.

  1. Limitation of Liability

We will not indemnify for indirect damages or other costs relating to indirect damages. Our liability for any direct damage is not more than the price you paid for the product in our Shop.

 

 

  1. Changes to these General Terms and Conditioons

The Finland Shop Oy reserves the right to change the GTC. Changes are published in the Shop. By using the Shop you agree to these updated GTC.

 

 

  1. Applicable Law and Settlement of Disputes

Finnish law covers these General Terms and Conditions.

All disputes regarding this agreement shall be resolved primarily through discussions between you and The Finland Shop Oy. If disagreements between the parties cannot be resolved in discussions, you have the right to refer the matter to the Finnish Consumer Disputes Board. If the dispute or disagreement reaches the court, it will be settled in the District Court of East Uusimaa in Porvoo.

These terms do not limit your statutory rights.
